These Terms of Service govern your use of Zabarda AI's website and services. Please read them carefully before engaging us.
01Agreement to Terms
By engaging Zabarda AI or using our website, you agree to these Terms of Service. If you do not agree with any part, do not use our services. These terms apply to all clients and visitors.
02Services
Zabarda AI provides done-for-you AI systems, including AI receptionist, AI chatbot, AI-built websites, reputation management, and related automation services. The scope of each engagement is defined in a separate proposal or agreement. We reserve the right to refine or adjust service offerings as technology evolves.
03Payment Terms
One-time builds are invoiced as quoted and are due per the schedule in your proposal. Monthly services are billed in advance on a recurring basis until cancelled. Payments are due on the invoice date. Accepted payment methods and currency are listed on your invoice. All fees are non-refundable unless otherwise stated in writing.
04Setup & Timelines
Most systems are live within 7 to 14 days; website builds typically take 2 to 3 weeks. Timelines depend on timely access to your accounts, brand assets, and required approvals. Zabarda AI is not responsible for delays caused by incomplete or delayed client input.
05Cancellation
Monthly services are month-to-month. You may cancel any monthly service with 30 days' written notice by emailing ajkhan@zabarda.ai. Cancellation stops future billing but does not refund the current billing period. One-time builds, once work has begun, are not refundable.
06Client Responsibilities
You agree to provide accurate information, timely access to required accounts, and prompt feedback during builds. You are responsible for the legality of the content and contacts you provide and for complying with applicable laws, including consent and privacy obligations.
07Intellectual Property
Upon full payment, custom deliverables created specifically for you are transferred to you to the extent permitted by our third-party tool providers. Underlying platforms, templates, and pre-existing tools remain the property of Zabarda AI or its licensors. We may showcase completed work in our portfolio unless you opt out in writing.
08Limitation of Liability
Zabarda AI provides services on an "as is" basis. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost revenue, leads, or profits arising from your use of our services. Our total liability is limited to the fees paid in the three months preceding any claim.
09Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Ontario, and you consent to that jurisdiction.
10Changes to Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated revision date. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
